IN THE OFFICE OF ADMINISTRATIVE HEARINGS

This matter came on for further hearing on January 26, 2012, at 1:00 p.m. The Complainant appeared on his own behalf and the Respondent appeared through its attorney, Corey Larson. At the onset of the scheduled further hearing the Respondent renewed its motion to vacate the scheduled hearing on the basis that the Registrar’s Order in ROC Case No. T10-0203 suspends the Respondent’s License for thirty (30) days and allows the Complainant to seek the cost of replacing the tile flooring at issue from the Contractors’ Recovery Fund and that it would be duplicitous to continue with the further hearing regarding hollow sounding tiles in the same tile floor. After discussion and after the Respondent’s specific statement that it does not plan to seek a rehearing or file an appeal of the Registrar’s Order in Registrar of Contractors Case No. T10-0203, the Complainant moved to vacate the further hearing and for the withdrawal of the Complaint at issue. The Respondent concurred with the Complainant’s motion to vacate. Whereupon, good cause appearing, this matter is vacated from the docket of the Office of Administrative Hearings and remanded to the Registrar for above reasons.
