IN THE OFFICE OF ADMINISTRATIVE HEARINGS

Respondent Arizona Custom Contracting, Inc. dba All Valley Custom Contracting has provided a copy of a settlement agreement signed by Complainant Laurie Collis under which Respondent agreed to perform the work required by the Registrar of Contractors’ Corrective Work Order (“CWO”), as well as additional work that the CWO did not require “to discontinue all legal claims between both parties in their entirety.” The Administrative Law Judge treats the document as a motion to vacate the hearing based on the parties’ settlement. Therefore, IT IS ORDERED vacating the hearing that had been scheduled on March 22, 2012, at 8:00 a.m., without prejudice to Complainant’s right to request that the Registrar reopen her complaint if Respondent fails to fully perform the work on the CWO in a professional and workmanlike manner. IT IS FURTHER ORDERED remanding this matter under A.A.C. R2-19-111(3) to the Director of the Arizona Registrar of Contractors for further action. Done this day, March 9, 2012.
