IN THE OFFICE OF ADMINISTRATIVE HEARINGS

On November 14, 2011, the parties appeared at the appointed time and place for hearing in these consolidated matters. Complainant Rebecca Griffiths appeared on her own behalf. Respondent Hornick Contracting Co Inc. was represented by its President and Qualifying Party John Hornick. Respondent DLM Building and Design, Inc. was represented by attorney Ivy Kushner, accompanied by corporate President and Qualifying Party Donald Matteson. After lengthy discussion, during the opening statement phase of the hearing, to determine the scope of the hearing issues as determined by the two Citation and Complaints issued by the ROC, Complainant decided that her case would be better presented in another forum. Complainant then, on the record and voluntarily, withdrew both complaints. Good cause appearing, and based on withdrawal of the complaints,
