Vacate: Settlement Recommendation

IN THE OFFICE OF ADMINISTRATIVE HEARINGS

Pursuant to the Notice of Hearing issued by the Registrar of Contractors, the above-entitled matter came on for hearing before the Office of Administrative Hearings on August 30, 2011, at 1:00 p.m. Neff Rental, L.L.C. (“Complainant”) was represented by its authorized representative, Pam Heim. S and B Installations, L.L.C. (“Respondent”) was represented by its authorized representative, Butch Randolph. Respondent is the holder of License No. 143725 issued by the Registrar. Complainant filed a written Complaint with the Registrar alleging nonpayment by Respondent for supplies provided by Complainant. The Registrar designated the Complaint as Case No. 2011- 2343. The Registrar issued a Citation and Complaint in Case No. 2011- 2343 charging Respondent with violating the provisions of A.R.S. § 32- 1154(A) (11) and (15). The Registrar forwarded Case No. 2011-2343 to the Office of Administrative Hearings, an independent agency, for an evidentiary hearing. At the commencement of the hearing, the parties announced that they had reached a settlement agreement, the essential terms of which were read into the record. Respondent agreed to pay Complainant the sum of $1,000.00 by September 30, 2011. Respondent further agreed to pay Complainant the sum of $1,172.50 by October 25, 2011. In view of the foregoing, IT IS ORDERED that the hearing in this matter be vacated and that Case No. 2011-2343 be remanded to the Registrar for further action.
