Vacate: Settlement Recommendation

IN THE OFFICE OF ADMINISTRATIVE HEARINGS

The parties appeared for hearing on November 30, 2011. Complainants appeared on their own behalf. Respondent appeared through sole Member and Qualifying Party Michael Rafi and was represented by attorney Kevin Bumstead. During the opening of the hearing, the parties came to an agreement that makes further administrative hearing unnecessary. The parties put a general statement of their agreement in writing and signed it. A copy of that agreement has been made part of the file for this matter and is being forwarded to the ROC. The agreement is essentially a mutual waiver and release, which includes a withdrawal of the complaint. The parties intend to make a more detailed written agreement in the near future. The parties are aware that, as stated in the Notice of Hearing under “Resolution Short of Adjudication,” upon notice of this settlement and Complainants’ withdrawal of the complaint, the Registrar of Contractors will close the complaint and note it as “resolved/settled/withdrawn.” Good cause appearing, IT IS HEREBY ORDERED that the hearing in this matter be vacated.

FURTHER, IT IS RECOMMENDED that the Registrar of Contractors, based on the agreement and withdrawal of the complaint, close this matter.
