IN THE OFFICE OF ADMINISTRATIVE HEARINGS

On May 17, 2011, the parties appeared at the appointed time and place for hearing in this matter. Complainant was represented by Melanie Yates, Credit Associate. Respondent was represented by its Managing Member and Qualifying Party Robert Radic. During the beginning phase of the hearing, the parties reached agreement and did not need to continue the formal hearing process. Complainant agreed to withdraw the complaint in return for Respondent’s promise to pay $4,185.43 to Complainant. Respondent agreed to pay Complainant $4,185.43 by making payments of $250.00 per month, on or before the 27th day of each month, beginning May 2011. The parties are aware that, as stated in the Notice of Hearing under “Resolution Short of Adjudication,” upon notice of this settlement and Complainants’ withdrawal of the complaint, the Registrar of Contractors will close the complaint and note it as “resolved/settled/withdrawn.” The parties are also aware that Complainant may request a compliance hearing should Respondent not fulfill its promise. Good cause appearing, and based on withdrawal of the complaint,
