On February 24, 2011, Frank J. Salazar, Inc., dba F J S Construction (“Respondent”) filed a motion to dismiss the complaint filed by Don Doyle (“Complainant”) under A.R.S. §§ 32-1155(C) and 32-1155(A). Because Complainant has not filed a timely response to the motion to dismiss, the Administrative Law Judge has on this date issued a recommended decision to the Registrar of Contractors (“the Registrar”) on the merits of the motion. Therefore, IT IS ORDERED vacating the hearing on the merits that had been scheduled on March 30, 2011, at 1:00 p.m. IT IS FURTHER ORDERED remanding this matter to the Director of the Registrar pursuant to the Administrative Law Judge’s recommended decision that was transmitted to the Registrar on this date.
