Vacate: Settlement Recommendation

IN THE OFFICE OF ADMINISTRATIVE HEARINGS

On May 4, 2011, Respondent appeared at the appointed time and place for hearing in this matter. Respondent was represented by Henry Jaffe. Complainant had telephoned the tribunal the day before and stated that he would not be present. No hearing was held because Respondent’s representative submitted a written settlement agreement resolving the case. The written agreement contains terms that each party agrees to. A copy of that agreement has been made part of the file for this matter. One of the terms of the agreement is the withdrawal of the complaint in this matter. The parties are aware that, as stated in the Notice of Hearing under “Resolution Short of Adjudication,” upon notice of this settlement and Complainants’ withdrawal of the complaint, the Registrar of Contractors will close the complaint and note it as “resolved/settled/withdrawn.” Good cause appearing, IT IS HEREBY ORDERED that the hearing in this matter is vacated. FURTHER, IT IS RECOMMENDED that the Registrar of Contractors, based on the agreement and withdrawal of the complaint, close this matter.
