This matter was set for compliance hearing on November 16, 2011. After business hours on November 15, 2011, this tribunal received an electronically filed motion from Complainant asking to “discontinue my AZROC complaint 2010A-30847491-ROC.” Complainant explained that he did not believe this forum could get him the financial compensation he is seeking and he did not wish to spend anymore of his or the State’s time and resources pursuing Respondent in this forum. Complainant then addressed, point by point, a Motion to Dismiss filed by Respondent and dated November 1, 2011. At the time and place for hearing, neither party appeared. Because this matter is a compliance hearing, it was set to determine whether or not Respondent has complied with a previous Order, dated January 12, 2011. Because neither party appeared and presented evidence, there is no evidentiary record upon which to make such a determination. Therefore, this matter should be closed with finality. Good cause appearing, IT IS ORDERED vacating the hearing in this matter and remanding this case to the Registrar of Contractors for any further action.

IT IS HEREBY RECOMMENDED that the matter be closed with prejudice, meaning without opportunity to reopen.
