Vacate: Settlement Recommendation

IN THE OFFICE OF ADMINISTRATIVE HEARINGS

A hearing was commenced on this date, at which Complainants Ira and Lucy Feuerstein testified and submitted exhibits, Respondent AZ Creative Landscapes, L.L.C.’s qualifying party, Mike Browning, testified, and the Registrar of Contractors’ inspector, Ted Gerold, testified. The parties resolved their dispute during a recess. Following the recess, the terms of the settlement were recited onto the record. Complainants agreed to withdraw their complaint pursuant to the settlement and Respondent agreed to perform the terms of the settlement. Because the terms of the settlement are fair and equitable under the circumstances, IT IS ORDERED vacating the remainder of the hearing on the merits that had been scheduled on this date. IT IS FURTHER ORDERED remanding this matter under A.A.C. R2-19-111(3) to the Director of the Arizona Registrar of Contractors with the recommendation that it be closed as resolved/settled/withdrawn.
