On November 10, 2010, the parties appeared at the appointed time and place for hearing in this matter. Complainant was represented by its President and Qualifying Party Tom Zittle, accompanied by counsel Mike Hurley. Respondent appeared on his own behalf. At the start of the hearing, the Administrative Law Judge was informed that Complainant wished to withdraw the complaint and pursue this matter in the civil courts, as there is a pending suit and counter-suit between the parties. Complainant confirmed this on the record. Good cause appearing, and based on withdrawal of the complaint, IT IS RECOMMENDED that the Registrar of Contractors close this matter.
