IN THE OFFICE OF ADMINISTRATIVE HEARINGS

Respondent Payne and Sons Construction Corp. has moved to vacate the hearing and to dismiss Complainant Dane Gudex’s complaint because, “[o]n May 13, 2010, we installed a new A.R.S. § bar flashing and a new counter flashing on the wall” and “[t]he work performed is to the customer’s satisfaction . . . .” Complainant has not responded to the motion in the time allowed by applicable regulation. Therefore, IT IS ORDERED vacating the hearing that had been scheduled on July 27, 2010 at 1:00 p.m. IT IS FURTHER ORDERED remanding this matter under A.A.C. R2-19-111(3) to the Director of the Arizona Registrar of Contractors for further action. Done this day, June 14, 2010.
