The Registrar rejects the Administrative Law Judge’s attached Recommended Order. Instead, IT IS ORDERED that Respondent’s License No. C-30.200493-R be revoked on the effective date of this Order. Pursuant to A.R.S. §32-1154(D), IT IS FURTHERED ORDERED that Respondent pay $250.00 as a civil penalty to the Registrar. If Respondent fails to pay this civil penalty on or before 30 days following the effective date of this Order, the Registrar shall automatically revoke Respondent’s license again on that date. No future license shall be issued to any entity consisting of persons associated with Respondent, as defined by A.R.S. §32-1101(A)(5), unless payment of any outstanding civil penalty is made. Justification: Respondent’s license is expired, as well as suspended for Recovery Fund payouts of approximately $24,970.00. The appropriate discipline in this matter is unconditional revocation. Based on this Order, the Decision, as modified, shall become effective on August 6, 2013. Any request for rehearing must be filed on or before August 1, 2013. Any appeal to the Superior Court must be filed on or before the effective date set forth above.
