Vacate: Settlement Recommendation

IN THE OFFICE OF ADMINISTRATIVE HEARINGS

Pursuant to the Notice of Recovery Fund Eligibility/Payout Hearing issued by the Registrar of Contractors (“Registrar”), the above-entitled matter came on for hearing before the Office of Administrative Hearings (“OAH”), an independent agency, for an evidentiary hearing on July 29, 2011, at 8:00 a.m. Richard T. Dolezal (“Complainant”) appeared personally. Covenant Painting, Inc. (“Respondent”) did not appear. The Registrar was represented by Assistant Attorney General Montgomery Lee. The commencement of the hearing was delayed 15 minutes to allow for the late arrival of Respondent’s authorized representative. After the delay, the Administrative Law Judge conducted the hearing in Respondent’s absence. At the commencement of the hearing, Complainant and the Registrar’s counsel announced a settlement agreement between the parties to remand this matter back to the Registrar for further investigation. In view of the foregoing, IT IS ORDERED that this matter be vacated from the calendar of the OAH and that it be remanded to the Registrar for further action.
