IN THE OFFICE OF ADMINISTRATIVE HEARINGS

Pursuant to the Notice of Hearings issued by the Registrar of Contractors (“Registrar”), this matter came on for hearing before the Office of Administrative Hearings, an independent agency, on August 5, 2010, before Administrative Law Judge Brian Brendan Tully. Phoenix Sheet Metal Works, Inc. did not appear. Flagstaff Roofing Co., Inc. was represented by its authorized representative, Michael R. Allen. The Notice of Hearing advised the parties of the time, date, and location of the formal hearing. The Notice of Hearing was sent to the parties at their addresses of record with the Registrar. The commencement of the scheduled hearing was delayed 15 minutes to allow for the late arrival of Complainant’s authorized representative. After the delay, the Administrative Law Judge conducted the hearing in Complainant’s absence. The Registrar issued a Citation and Complaint charging Respondent with violating the provisions of A.R.S. § 32-1154(A) (11) for nonpayment of an outstanding debt owed by Respondent to Complainant. At hearing, Mr. Allen stated that Respondent has now paid Complainant the claimed outstanding balance owed to Complainant, plus 15% interest. In view of the foregoing, IT IS ORDERED that the hearing in this matter be vacated and that Case No. 2010-1190704 be remanded to the Registrar for further action.
