Vacate: Settlement Recommendation

IN THE OFFICE OF ADMINISTRATIVE HEARINGS

A hearing on the merits was commenced on this date. The Administrative Law Judge called a recess to allow Complainant Frederick L. Becker and the Arizona Registrar of Contractors (“the Registrar”) to exchange their exhibits and to review their opponents’ exhibits. After the recess, the parties informed the Administrative Law Judge that they had reached an agreement to settle their dispute and recited the essential terms of their agreement on the record. Therefore, IT IS ORDERED vacating the remainder of the hearing on the merits that had been scheduled on this date at 1:00 p.m. IT IS FURTHER ORDERED remanding this matter under A.A.C. R2-19-111(3) to the Director of the Registrar with the recommendation that the Residential Contractors’ Recovery Fund pay the settlement amount, after verifying that a properly licensed contractor had submitted the bid on which the Registrar’s good-faith offer at hearing was based.
