IN THE OFFICE OF ADMINISTRATIVE HEARINGS

On April 28, 2011, the parties appeared at the appointed time and place for hearing in this matter. Complainants appeared on their own behalf. Respondent did not appear. Assistant Attorney General Montgomery Lee appeared on behalf of the Residential Contractors’ Recovery Fund (“the Fund”). At the start of the hearing, Mr. Lee informed the tribunal that Complainants had evidence of damages from Respondent that had not been included in the claim. The parties agreed that the matter should be remanded to the ROC so that Complainants can obtain bids and a new notice of payout can be issued. Complainants retain the right to request a hearing based upon that new notice. Therefore, IT IS ORDERED vacating the hearing in this matter and remanding this case to the Registrar of Contractors for further action.
