IN THE OFFICE OF ADMINISTRATIVE HEARINGS

Pursuant to the Notice of Compliance Hearing issued by the Registrar of Contractors, this matter came on for hearing before the Office of Administrative Hearings on July 30, 2010. The scope of the compliance hearing was “to determine whether or not Respondent has fully complied with the terms set forth in the parties’ Settlement Agreement.” The Notice of Compliance Hearing was sent to Complainant, Complainant’s counsel, and Respondent at their respective addresses of record with the Registrar of Contractors. The commencement of the scheduled hearing was delayed 15 minutes to allow for the late arrival of authorized representatives for Complainant and Respondent. After the delay, the Administrative Law Judge proceeded in the parties’ absence. In view of the foregoing and pursuant to A.A.C. R2-19-117, IT IS ORDERED that the compliance hearing be vacated from the calendar of the Office of Administrative Hearings, and that this matter be remanded to the Registrar of Contractors for further action.
