Following the rehearing in this matter that convened and concluded on April 15, 2019, Petitioner John A Sellers submitted supplemental authority and argument to the Office of Administrative Hearings (OAH) via the OAH website. On or about April 29, 2019, counsel for Respondent Rancho Madera Condominium Association arguing that Petitioner’s filing was untimely and presented a new argument not brought forth during the hearing. Respondent requested that the Administrative Law Judge disregard Petitioner’s filing and strike it from the record. The rehearing in this matter was held on April 15, 2019, pursuant to proper notice by the Office of Administrative Hearings and provided both parties with an opportunity to present any evidence and argument relevant to the proceeding. At the conclusion of the hearing, neither party requested leave to file any supplemental information. Upon consideration of the filings, IT IS ORDERED striking the filing from the record. IT IS FURTHER ORDERED closing the record in this matter on May 7, 2019. Done this day, May 7, 2019.
