ORDER HOLDING RECORD OPEN

This matter came for hearing and closing arguments before the Office of Administrative Hearings on February 12, 2020. At the conclusion of the proceeding, and after the record was closed, Petitioner submitted his Proposed Administrative Law Judge Decision (Proposed Decision) to the Administrative Law Judge (ALJ).

On or about February 20, 2020, the Arizona Department of Insurance (Department) submitted Department’s Motion to Strike (Motion). In its Motion, the Department requested that the ALJ strike Petitioner’s Proposed Decision from the record, or in the alternative, accept the Proposed Decision and allow the Department an opportunity to file its own proposed administrative law judge decision.

As the filing was made after the record closed and the Department did not otherwise have an opportunity to review or respond,

IT IS ORDERED reopening the record for the sole purpose of allowing the Department the opportunity to respond to Petitioner’s Proposed Decision. The Department’s filing is due no later than the close of business on March 2, 2020, at which time the record in this matter will close.

IT IS FURTHER ORDERED, if amenable to both parties, that Petitioner and the Department submit a stipulated finding of facts.
