ORDER DENYING DEPARTMENT’S MOTION TO STRIKE and REQUESTING COMPLIANCE WITH THE SUBMISSION DEADLINE

On February 20, 2020, the Administrative Law Judge (ALJ) issued an Order Holding Record Open upon receiving the Arizona Department of Insurance’s Motion to Strike (Motion). The ALJ’s intent was to give the Department the opportunity to respond to Petitioner’s Proposed Decision. The ALJ set a deadline for the Department to submit its Proposed Decision no later than the close of business on March 2, 2020. The ALJ also requested the parties to submit a stipulated finding of facts by that same date, if they so choose.

To clarify the record, the ALJ denies Department’s Motion to Strike and requests the parties adherence to the submission deadline of March 2, 2020. At the close of business day March 2, 2020, the record will officially close.

Sufficient cause appearing,
