As discussed at the conclusion of the parties’ presentation of evidence on this date, IT IS ORDERED holding the record open in this matter until October 11, 2016, to allow the parties’ attorneys to submit written closing argument. The written closing arguments should not exceed 20 pages. Attachments such as copies of case law, statutes, and regulations are not included in the page limitation. To help the parties’ attorneys prepare their written closing arguments, the final Exhibit List is attached to this order. The parties’ attorneys’ attention is called to note 1, which provides as follows: The format of [Respondents’ Exhibit 21] is an Excel spreadsheet. The administrative law judge informed the parties that in the event that the Board’s final decision is appealed to the Maricopa County Superior Court, the court requires the Office of Administrative Hearings’ (“OAH’s”) records of exhibits that were submitted in administrative hearings to be transmitted electronically and that because OAH does not have the capacity to transmit an Excel spreadsheet electronically, the exhibit needs to be resubmitted in a .pdf format. The parties are notified that in the event of an appeal, Respondents’ Exhibit 21 will not be transmitted to the superior court unless the exhibit is provided in .pdf format.
