IN THE OFFICE OF ADMINISTRATIVE HEARINGS

For good cause appearing, this matter is vacated from the docket of the Office of Administrative Hearings and remanded for the following reason: When the hearing convened, a legal issue arose as a preliminary matter and the parties were given an opportunity to discuss off the record, outside of the Administrative Law Judge’s presence, how they wished to procedurally address the legal issue. When the hearing re-convened, Petitioner withdrew her appeal and request for hearing. Arizona Administrative Code R2-19-111(3) requires the Administrative Law Judge to vacate and return the matter to the referring agency when a non-agency party withdraws an appeal.
