IN THE OFFICE OF ADMINISTRATIVE HEARINGS

A hearing was commenced on this date, at which the parties presented evidence and made argument. During the hearing, Respondent Enterprise Floors LLC’s representative Michael Rafi offered to settle Complainant Emiko Hosoya’s complainant to the Registrar of Contractors under the following terms: (1) Within a week, Respondent would give Ms. Hosoya a check drawn on its business account in the amount of $828.75; and (2) Within a week, Respondent would schedule installation of carpet at Ms. Hosoya’s home in the areas originally contemplated under the parties’ May 28, 2009 agreement. Ms. Hosoya agreed on the record to withdraw her complaint to the Registrar as consideration for Respondent’s performance of the settlement agreement and to allow Respondent to install carpet at her home. Therefore, IT IS ORDERED vacating the remainder of the hearing on the merits that had been scheduled on this date. IT IS FURTHER ORDERED remanding this matter under A.A.C. R2-19-111(3) to the Director of the Arizona Registrar of Contractors with the recommendation that it be closed as resolved, settled, or withdrawn. Done this day, February 19, 2010.
