On March 1, 2010, the parties appeared at the appointed time and place for hearing in this matter. Complainant Pinnacle Peak Plastering was represented by its Qualifying Party and President Fernando Rojo. Respondent was represented by its President and Qualifying Party James Wilcox. Respondent’s license is currently suspended for lack of bond. The parties discussed the case both on and off the record. Complainant was informed of its options for proceeding and, after the options, Complainant determined to withdraw the complaint at this time, but may re-file it in the future. Good cause appearing, and based on withdrawal of the complaint, IT IS RECOMMENDED that the Registrar of Contractors close this matter without prejudice, meaning that Complainant may re-file within the two year complaint period.
