STATE OF ARIZONA IN THE OFFICE OF ADMINISTRATIVE HEARINGS

These consolidated matters are scheduled to convene for hearing via videoconference on September 29, 2009. On September 28, 2009, the parties, by and through counsel, filed the attached Notice of Settlement and Stipulation to Vacate Hearing (“notice”) wherein it was represented that the parties had “settled their disputes, by separate agreement,…and pursuant to R2-19-111 they stipulate to vacate the consolidated hearings….” For purposes of these consolidated matters, and due to the content of the foregoing, the above-referenced notice will be deemed to be a motion to vacate the instant hearing pursuant to A.A.C. R2-19-111(1). Based on the foregoing, and sufficient cause otherwise appearing, IT IS ORDERED that the hearing in this matter set for September 29, 2009 at 8:15 a.m. be and hereby is VACATED from the calendar of the Office of Administrative Hearings; and, IT IS FURTHER ORDERED that these consolidated matters be remanded to the Registrar of Contractors for appropriate further action.
