A hearing was commenced on this date, as noticed by the Arizona Registrar of Contractors (“the Registrar”). Complainant Kenneth Osborn on his own behalf and Daniel Noma Sr. on Respondents’ behalf began presenting evidence and making argument. The Registrar’s Inspector Dennis Cook testified and answered the parties’ questions. During a recess, Mr. Osborn and Mr. Noma discussed their dispute and reached a settlement, the terms of which they confirmed on the record to the Administrative Law Judge. Therefore, IT IS ORDERED vacating the hearing on the merits that had been scheduled on this date at 1:00 p.m. IT IS FURTHER ORDERED remanding this matter under A.A.C. R2-19-111(3) to the Director of the Arizona Registrar of Contractors for further action. Done this day, October 15, 2009.
