STATE OF ARIZONA IN THE OFFICE OF ADMINISTRATIVE HEARINGS

This matter convened for hearing at the time, date and place set forth in the Registrar of Contractors’ Notice of Hearing dated July 30, 2009. Complainant, Bruce Smiley, appeared, pro per. Jeff Lessi (“Lessi”), superintendent, appeared on behalf of Respondent, pro per. Prior to the presentation of any testimony or evidence, Complainant advised the undersigned that he did not intend to present any evidence in support of his claims against Respondent and moved to withdraw his Complaint and vacate the hearing. Lessi did not object to such motion. Based on the foregoing, and sufficient cause otherwise appearing, IT IS ORDERED that the hearing in this matter set for October 7, 2009 at 1:00 p.m. be and hereby is VACATED from the calendar of the Office of Administrative Hearings; and, IT IS FURTHER ORDERED that this matter be remanded to the Registrar of Contractors for appropriate further action.
