Pending before the Office of Administrative Hearings is a Notice of Voluntary Dismissal (Withdrawal) of Complainant’s Citation and Complaint and Request that the Hearing Set for September 22, 2009 be Vacated (“Notice”) submitted on September 8, 2009. Pursuant to the Notice, Complainant J. L. Baugh Construction Co., through counsel, has requested that the hearing in this matter, currently scheduled for September 22, 2009, be vacated for the reason that Complainant has withdrawn its filed complaint against Respondent Shelly Construction, L.L.C. Sufficient cause appearing, IT IS HEREBY ORDERED VACATING this matter from the docket of the Office of Administrative Hearings and remanding it to the Registrar of Contractors for appropriate disposition.
