On July 29, 2009, the parties appeared at the appointed time and place for hearing in this matter. Complainant American Shotcrete was represented by its President Robert Porter. Respondent was represented by Jerry Mason, Controller. The parties discussed the case both on and off the record. Complainant’s representative was informed of the options for proceeding and, after consideration, Complainant’s representative determined to drop the complaint at this time. Complainant may re-file the matter at a future date. Respondent made no agreement with Complainant. Good cause appearing, and based on withdrawal of the complaint, IT IS RECOMMENDED that the Registrar of Contractors dismiss this matter without prejudice.
