STATE OF ARIZONA OFFICE OF ADMINISTRATIVE HEARINGS

On July 23, 2009, the parties appeared at the appointed time and place for hearing in this matter. Complainant Bear Construction was represented by its Qualifying Party/Vice President Barry Smith and President Christy Smith. Respondent Headlee Roofing was represented by Vice President Rick Headlee. The parties discussed the case both on and off the record and came to an agreement that made a formal hearing unnecessary. Respondent agreed to pay Complainant $4,000.00 upon Complainant’s withdrawal of the complaint. Complainant agreed to withdraw the complaint upon Respondent’s agreement to pay $4,000.00. Thus, no hearing was held. The parties are aware that, as stated in the Notice of Hearing under “Resolution Short of Adjudication,” upon notice of this settlement and Complainants’ withdrawal of the complaint, the Registrar of Contractors will close the complaint and note it as “resolved/settled/withdrawn.” Good cause appearing, and based on withdrawal of the complaint,
