The Arizona Department of Weights and Measures (“the Department”) has notified the Office of Administrative Hearings that the parties have reached a settlement and has provided a copy of a fully executed Consent Agreement for Civil Penalty that resolves all disputed issues in these consolidated matters. Therefore, IT IS ORDERED vacating the hearing that had been scheduled on September 30, 2008 at 10:30 a.m. IT IS FURTHER ORDERED remanding this appeal under A.A.C.
