IN THE OFFICE OF ADMINISTRATIVE HEARINGS

The administrative hearing of this matter was convened on May 27, 2009 at 9:00 a.m., with both parties present. On May 26, 2009, the Office of Administrative Hearings received a facsimile transmittal from Respondent Spartan Plumbing’s attorney informing that he is representing Spartan Plumbing in its Chapter 11 bankruptcy proceeding in federal court, docket no. 4-09-bk-090626-JMM. Respondent’s supervisor Mr. Michael McInnis confirmed this fact. Satisfactory information of the bankruptcy proceeding having been received, Complainant was asked on the record if he had obtained any order of relief from the automatic stay provisions of the bankruptcy laws. Complainant indicated he had not even been made aware that the Respondent was a debtor in bankruptcy court. No order of relief from the stay order has been issued by Judge Marlar. Wherefore, it is hereby ordered vacating this matter from the OAH docket and remanding same to the Registrar of Contractors for its further action. Done this day, May 27, 2009.
