The Respondent has filed notice of its previously filed petition in bankruptcy in U.S. District Court case no. 4:08-bk-12680-JMM and that as a direct result thereof, there now exists an automatic stay of proceedings against Respondent pursuant to 11 U.S.C. §362(a). Therefore, good cause appearing, the above-entitled matter is vacated from the calendar of the Office of Administrative Hearings and it is hereby recommended that this Citation, together with the Complaint upon which it is based, shall be closed unless the Complainants file notice with the Registrar of Contractors on or before the effective date of the Order entered in this matter that they have instituted proceedings before the appropriate Federal Court seeking relief from the aforesaid automatic stay.
