STATE OF ARIZONA IN THE OFFICE OF ADMINISTRATIVE HEARINGS

The hearing in this matter convened via videoconference at the time, date and place set forth in the Registrar of Contractors’ Notice of Hearing dated March 16, 2009. Complainant appeared, pro per; Larry Lee McBride, corporate officer and qualifying party, appeared on behalf of Respondent, pro per. Prior to the presentation of any testimony or evidence, a discussion ensued off the record by and between the parties and Registrar of Contractors Inspector Cliff Corlett under the direction of the Administrative Law Judge. As a result of this discussion, Complainant advised the undersigned that he had decided not to proceed with the hearing given the revoked status of Respondent’s license and his inability to obtain any resolution other than additional discipline of Respondent’s license. Complainant further related that he intended to pursue his remedies against Respondent in civil court. Based on the foregoing, and sufficient cause appearing, IT IS ORDERED that the matter herein be and hereby is VACATED from the docket of the Office of Administrative Hearings; and, IT IS FURTHER ORDERED that the matter be remanded to the Registrar of Contractors for further appropriate action.
