STATE OF ARIZONA IN THE OFFICE OF ADMINISTRATIVE HEARINGS

This matter is scheduled to convene for hearing via videoconference on February 18, 2009 pursuant to the Registrar of Contractors’ Notice of Hearing dated January 13, 2009. On January 16, 2009, Complainants filed via facsimile with the Office of Administrative Hearings the attached correspondence wherein the requested that “this hearing for February 18, 2009 be vacated.” Annexed to the correspondence was a letter from Complainants’ counsel and an Order issued by the Honorable Charlene S. Weis, of the Parker Justice Court of the State of Arizona in and for the County of La Paz which reflected that the parties “have reached a stipulated agreement to settle all claims and counter claims in this matter for a payment of seven-thousand dollars ($7,000.00) from [Complainants herein to Respondent]….” Pursuant to such Order, Complainants also agreed “to terminate any administrative complaints.” For purposes of this matter, the above-referenced correspondence will be deemed motion to vacate the instant hearing pursuant to A.A.C. R2-19- 111(4). Based on the foregoing, and sufficient cause otherwise appearing, IT IS ORDERED that the hearing in this matter set for February 18, 2009 at 1:15 p.m. be and hereby is VACATED from the calendar of the Office of Administrative Hearings; and, IT IS FURTHER ORDERED that this matter be remanded to the Registrar of Contractors for further appropriate action.
