STATE OF ARIZONA IN THE OFFICE OF ADMINISTRATIVE HEARINGS

The hearing in these consolidated matters is scheduled to convene via videoconference on February 19, 2009 pursuant to a Notice of Hearing issued by the Registrar of Contractors. On February 9, 2009, Complainants, by and through counsel, filed via facsimile the attached motions to withdraw complaint (“motions”) wherein they request that their complaints be “withdrawn” on the basis, inter alia, that “it is best that the matter proceed as a civil action in the Superior Court.” Fro the purpose of these matters, and due to the content of the foregoing, the above-referenced motions will be deemed to be motions to vacate the instant hearing pursuant to A.A.C. R2-19-111(4). Based on the foregoing, and sufficient cause otherwise appearing, IT IS ORDERED that the hearing in these consolidated matters set for February 19, 2009 at 8:15 a.m. via videoconference be and hereby is VACATED from the calendar of the Office of Administrative Hearings; and, IT IS FURTHER ORDERED that these consolidated matters be remanded to the Registrar of Contractors for appropriate further action.
