IN THE OFFICE OF ADMINISTRATIVE HEARINGS

The Department of Weights and Measures (“the Department”) has notified the Office of Administrative Hearings that the licensee Scott’s Sinclair and the Department were able to resolve all matters in dispute at an informal settlement conference held on April 29, 2008. The Department attached to its notice a copy of a fully executed Consent Agreement for Civil Penalty in this matter. Therefore, IT IS ORDERED vacating the hearing that had been scheduled on June 11, 2008 at 1:30 p.m. IT IS FURTHER ORDERED remanding this appeal under A.A.C. R2-19-111(3) to the Director of Department for further action. Done this day, April 29, 2008.
