The Arizona Department of Weights and Measures (“the Department”) has moved to dismiss the hearing pursuant to the parties’ settlement. The Department attached to its motion a copy of a fully executed Consent Agreement for Civil Penalty. Therefore, IT IS ORDERED vacating the hearing that had been scheduled on August 22, 2007 at 1:30 p.m. IT IS FURTHER ORDERED remanding this appeal under A.A.C.
