IN THE OFFICE OF ADMINISTRATIVE HEARINGS

The Arizona State Board of Accountancy (“the Board”) has moved to vacate the hearing in this matter because Applicant Danielle Knowles, the party who will bear the burden of proof at the hearing, has withdrawn her appeal. The Board attached to its motion a copy of a letter from Ms. Knowles. Therefore, IT IS ORDERED vacating the hearing that had been scheduled on September 5, 2007 at 9:00 a.m. IT IS FURTHER ORDERED remanding this appeal under A.A.C. R2-19-111(3) to the Executive Director of the Board for further action. The Administrative Law Judge notes that Ms. Knowles’ letter admits that she cannot produce the requisite evidence to establish that she meets all statutory requirements to be granted a Certified Public Accountant (“CPA”) certificate in Arizona. However, Ms. Knowles takes issue with paragraphs 10, 11, 12, and 25 of the Notice of Public Hearing. The Administrative Law Judge lacks authority to redact notices issued by other agencies. The notice of hearing sets forth only allegations, not proven facts. The Administrative Law Judge notes only that Ms. Knowles does not admit the allegations in paragraphs 10, 11, 12, and 25 of the Notice of Hearing, but that her admitted inability to furnish the requisite proof of having met other statutory requirements would appear to support the Board’s decision to deny her application at this time.
