IN THE OFFICE OF ADMINISTRATIVE HEARINGS

The administrative hearing of this matter was scheduled to convene on October 9th, 2007, at 9:00 a.m. in the Office of Administrative Hearings, Tucson. On October 9th, 2007, at 8:22 a.m., the OAH-Tucson received a faxed motion to vacate from the Complainant, stating that he wishes to have the matter dismissed as he will not be able to attend the hearing. Considering the nature of the motion, no response from the Respondent is necessary. Wherefore, good cause appearing, and in accordance with A.A.C. R2-19- 111.4, it is hereby ordered canceling the scheduled hearing, vacating this matter from the OAH docket and remanding same to the Registrar of Contractors for its further action.
