Vacate: Settlement Recommendation

IN THE OFFICE OF ADMINISTRATIVE HEARINGS

This matter was convened for administrative hearing in the Office of Administrative Hearings, Tucson. At the call of the case the parties announced that they had achieved a settlement agreement which they wish to urge upon the Registrar as the final resolution of this case. The parties agreed as follows: (1) Respondent has now obtained all necessary permits, and Complainants agree to pay for the application costs of obtaining them; (2) Complainants agree to pay the subcontractors working on the project, and the costs of needed materials; (3) Respondent agrees to remain on the job and oversee the subcontractors and the proper completion of the project as contracted; (4) the parties agree that if any compliance hearing becomes necessary in the future, that the issues at such a hearing shall be limited to those concerning performance of the settlement agreement. Wherefore, it is hereby ordered vacating this matter from the OAH docket and remanding same to the Registrar of Contractors for its further action with a recommendation to approve and adopt the parties’ settlement agreement.
