Vacate: Settlement Recommendation

IN THE OFFICE OF ADMINISTRATIVE HEARINGS

This mater came on for administrative hearing in the Office of Administrative Hearings, Tucson, on November 26th, 2007. Both parties were present and represented themselves. During the hearing the parties achieved a settlement agreement which they wish to urge upon the Registrar as the final resolution of this case. The parties agreed that the case may be closed as settled upon the Respondent paying the Complainant the sum of $262.45, an amount Complainant alleged as the necessary cost of repairs to the rental unit he owns. No finding of causation was made on the record, and the parties agree that upon payment of this amount from Respondent to Complainant the case may be closed as settled. Any future compliance hearing shall be limited to those concerning performance of the Agreement.

Wherefore, it is hereby ordered vacating this matter from the OAH docket and remanding same to the Registrar of Contractors with a recommendation to approve and adopt the Settlement Agreement. Done this day, November 27th, 2007.
