Vacate: Settlement Recommendation

IN THE OFFICE OF ADMINISTRATIVE HEARINGS

This matter was convened for administrative hearing in the Office of Administrative Hearings, Tucson. Immediately prior to the commencement of the hearing the parties announced that they were pursuing promising settlement negotiations, and requested the Administrative Law Judge to allow them some minutes to pursue that endeavor, which was allowed. Following their discussion had outside the presence and hearing of the ALJ, the parties announced they were ready to go on the record. At the commencement of the hearing the parties announced that they had in fact achieved a settlement agreement which they wish now to urge upon the Registrar as the final resolution of the case. The parties agreed quite simply that Respondent would tender to Complainant, and Complainant would accept, as the full and final settlement of all outstanding differences in this case, the sum of $2,200.00. The parties understood and agreed that upon tender and receipt of the sum this case shall then be closed as settled upon the effective date of the Registrar’s Decision and Order, and that any compliance hearing that might be made necessary shall be limited to issues concerning performance of the agreement. Wherefore, it is hereby ordered vacating this matter from the OAH Docket and remanding same to the Registrar of Contractors for its further action with a recommendation to approve and adopt the parties’ settlement agreement.
