Vacate: Settlement Recommendation

IN THE OFFICE OF ADMINISTRATIVE HEARINGS

This matter came on for hearing as scheduled. Prior to the receipt of any evidence, the parties entered a settlement agreement whereby the Respondent submitted documentation to the Department which if complete and accurate, would resolve the Citation and Complaint[1]. The Assistant Attorney General recommended that the matter be dismissed without prejudice to recharge the allegation if the documentation provided by the Respondent is incomplete, inaccurate, or otherwise materially deficient. It Is Recommended the Citation and Complaint be dismissed without prejudice. It Is Ordered the hearing of this matter is vacated and the matter is remanded to the agency for final disposition.
