This matter came on for hearing as scheduled. The Complainant sent a friend to appear for her. The Respondent did not appear at the hearing. Arizona Supreme Court Rule 31 regulates the practice of law in the State. Generally, persons may represent themselves or be represented by an attorney. There are numerous exceptions which allow lay representation by a person not receiving compensation for the representation. However, there is nothing in the rule which allows a non attorney to represent an individual in Registrar of Contractor hearings. In view of the above, no evidence was presented on behalf of the Complainant who has the burden of proof. It Is Ordered that the hearing is vacated and remanded to the Registrar of Contractors for final disposition.
