STATE OF ARIZONA IN THE OFFICE OF ADMINISTRATIVE HEARINGS

This matter is scheduled to convene for hearing via videoconference on June 20, 2007. On June 14, 2007, Complainant filed with the attached correspondence (“motion”) with the Office of Administrative Hearings wherein he advised that a settlement had been reached with Respondent and requested that the “case be closed and the hearing set for June 20th in Prescott be cancelled.” Thereafter, on June 15, 2007, Respondent, by and through Al Setter, filed its own correspondence (attached) which referenced Complainant’s letter and requested “the subject actions.” For purposes of this matter, and due to the content of the foregoing, the above-referenced correspondences will be deemed to be a stipulated motion to vacate the instant hearing pursuant to A.A.C. R2-19-111(1). Based on the foregoing, and sufficient cause otherwise appearing, IT IS ORDERED that the hearing in this matter set for June 20, 2007 at 1:15 p.m. be and hereby is VACATED from the calendar of the Office of Administrative Hearings; and, IT IS FURTHER ORDERED that this matter be remanded to the Registrar of Contractors for appropriate further action.
