IN THE OFFICE OF ADMINISTRATIVE HEARINGS

On a date prior to the date set for the hearing in the above-entitled matter, the Department of Weights and Measures effectively requested that the scheduled hearing in this matter be vacated because the parties have reached a settlement agreement and the Appellants have waived their right to an administrative hearing..

In view of the foregoing, and sufficient cause otherwise appearing herein, IT IS HEREBY ORDERED that the hearing in this matter be and hereby is vacated from the calendar of the Office of Administrative Hearings, and IT IS FURTHER ORDERED that this matter be remanded to the originating agency for its further action.
