At the conclusion of the state’s case, the Administrative Law Judge and the parties discussed whether Dr. Christensen would be afforded an opportunity to offer into evidence additional records of his treatment of patient BJV. Dr. Christensen elected to withdraw his appeal instead of requesting a further hearing. Therefore, IT IS ORDERED vacating the hearing on the merits that had been scheduled on this date. IT IS FURTHER ORDERED remanding this appeal under A.A.C. R2-19-111(3) to the Arizona State Board of Dental Examiners for further action. Done this day, September 19, 2007.
