IN THE OFFICE OF ADMINISTRATIVE HEARINGS

On the day of the scheduled hearing, the parties filed a communication with the Office of Administrative Hearings, indicating that everything on the Complainant had been “completed.” Due to the late filing of the communication, there was no time for this Tribunal to rule on the filing, prior to the time of the scheduled hearing. Thus, the parties remained on notice to appear for the scheduled hearing. Respondent appeared through its owner and qualifying party, Frank Marquez (“Marquez”) and Complainant did not appear for the hearing. Marquez confirmed that Respondent had corrected all remaining items on Complainant’s punch list. Based on the above-described filing by the parties, the statement of Marquez and the failure of Complainant to appear for the hearing, the above-entitled case is vacated from the calendar of the Office of Administrative Hearings and remanded to the referring agency for appropriate disposition.
